TERMS OF SERVICE

THE RETREAT MASSAGE & SPA

These Terms of Service (“Terms”) constitute a legal agreement between you (“Client”, “you”, or “your”) and GE Grullo LTD, trading as “The Retreat Massage & Spa” (“The Retreat”, “we”, “our”, or “us”) regarding your use of services provided at our facilities located in Manchester, United Kingdom (M4 4EX).

By booking, attending, or participating in any service provided by The Retreat Massage & Spa, you agree to be bound by these Terms and acknowledge that you are voluntarily waiving certain legal rights.

PART 1: RELEASE OF LIABILITY, WAIVER OF CLAIMS AND ASSUMPTION OF RISK

PLEASE READ CAREFULLY

In consideration of The Retreat Massage & Spa allowing you to participate in services including but not limited to:

  • Massage therapy

  • Sauna use

  • Ice bath therapy

  • Yoga classes

  • Pilates classes

  • Wellness sessions

  • Use of spa and relaxation areas

(collectively referred to as the “Services”), you agree to the following terms.

ASSUMPTION OF RISKS

You acknowledge that participation in spa, wellness, and physical activities may involve inherent risks including, but not limited to:

  • Muscle injury

  • Burns from sauna use

  • Cold shock or discomfort from ice baths

  • Slips or falls in wet areas

  • Dehydration

  • Physical strain from exercise classes

  • Serious injury, illness, or in rare cases death

You voluntarily assume all risks associated with participating in these Services.

You acknowledge that it is your responsibility to consult with a medical professional before participating in any wellness or physical activity offered by The Retreat Massage & Spa.

WAIVER OF CLAIMS

To the fullest extent permitted by law, you agree to waive any and all claims you may now or in the future have against:

GE Grullo LTD, trading as The Retreat Massage & Spa, including its:

  • owners

  • directors

  • employees

  • contractors

  • instructors

  • therapists

  • agents

  • affiliates

(collectively referred to as the “Releasees”)

for any injury, illness, loss, or damage arising from participation in the Services.

LIMITATION OF LIABILITY

If a court determines that any liability exists, the maximum liability of The Retreat Massage & Spa shall not exceed the greater of:

  1. The total amount paid by you to The Retreat Massage & Spa in the six (6) months prior to the claim, or

  2. £250

INDEMNIFICATION

You agree to indemnify and hold harmless The Retreat Massage & Spa from any claims, damages, or expenses arising from your participation in the Services.

GOVERNING LAW

These Terms shall be governed and interpreted in accordance with the laws of England and Wales.

Any disputes shall be handled exclusively by courts located in the United Kingdom.

PART 2: ELIGIBILITY

Clients must meet the following requirements:

  • 18 years or older, or

  • 16–17 years old with written parental or guardian consent

By booking a service, you confirm you meet these requirements.

The Retreat reserves the right to request proof of age or parental consent.

HEALTH DISCLAIMER

You acknowledge the following:

  1. Spa and wellness services may not be suitable for certain medical conditions.

  2. Services may not be appropriate for individuals who are:

    • pregnant

    • suffering from heart conditions

    • prone to fainting

    • suffering from high or low blood pressure

    • suffering from infectious illnesses

  3. The Retreat Massage & Spa does not provide medical advice.

You confirm that you:

  • are physically able to participate

  • have no conditions that would make participation unsafe

  • accept full responsibility for your health

If you feel unwell during any service, you must immediately inform a member of staff.

SPA & FACILITY RULES

For health and safety reasons:

• Guests must shower before entering sauna or ice baths
• Guests must remain hydrated
• Guests must follow all posted safety instructions
• Floors in wet areas may be slippery

Use of the following facilities is at your own risk:

  • sauna rooms

  • ice baths

  • wet areas

  • relaxation areas

The Retreat Massage & Spa cannot accept liability for injuries caused by failure to follow safety instructions.

YOGA & PILATES CLASSES

By participating in yoga or Pilates classes you acknowledge:

  • These activities involve physical exertion

  • Injury may occur if exercises are performed incorrectly

  • You will inform the instructor of any injuries or limitations

You agree to perform exercises within your personal limits.

ICE BATH & SAUNA SAFETY

Ice bath and sauna exposure may cause:

  • dizziness

  • fainting

  • cold shock

  • dehydration

You agree to:

  • enter and exit slowly

  • remain in facilities only as long as comfortable

  • immediately exit if feeling unwell

INFECTIOUS CONDITIONS

Guests must not attend the spa if they have:

  • contagious illnesses

  • fungal infections

  • verrucas

  • open wounds

This is to protect other clients.

BOOKINGS, PACKAGES & MEMBERSHIPS

The Retreat Massage & Spa offers:

  • individual bookings

  • treatment packages

  • membership subscriptions

All bookings are subject to availability.

PAYMENTS

Payments may be processed through:

  • credit card

  • debit card

  • approved payment processors

By purchasing a membership or package, you agree to all applicable payment terms.

MEMBERSHIPS

Memberships may be billed on a monthly or annual basis.

Memberships automatically renew unless cancelled prior to the renewal date.

Unused membership time is non-refundable.

CANCELLATION POLICY

Clients must cancel bookings within the time specified in their booking confirmation.

Failure to cancel within the allowed timeframe may result in:

  • loss of session

  • cancellation fee

  • deduction from membership or package

RIGHT TO REFUSE SERVICE

The Retreat Massage & Spa reserves the right to refuse service to any person who:

  • appears intoxicated

  • behaves aggressively

  • violates facility rules

  • poses a safety risk to themselves or others

PERSONAL BELONGINGS

Clients are responsible for their personal belongings.

The Retreat Massage & Spa accepts no responsibility for:

  • lost items

  • stolen items

  • damaged personal property

ELECTRONIC COMMUNICATIONS

By booking with The Retreat Massage & Spa you agree to receive communications including:

  • booking confirmations

  • appointment reminders

  • membership notifications

  • service updates

MODIFICATIONS TO TERMS

The Retreat Massage & Spa reserves the right to update these Terms at any time.

Updated Terms will apply upon continued use of the Services.
